How Do I Get a Divorce or Start a Divorce?
If you’re considering divorce, you may be wondering: How do I get a divorce? or Where do I start? Ending a marriage is a significant step, and understanding the legal process can help make it less stressful.
At Bank Solicitors, we specialise in divorce and family law, providing expert legal support for clients in Redditch, Bromsgrove, and the surrounding villages. Whether your divorce is straightforward or involves financial settlements and child arrangements, we are here to guide you every step of the way.
The Divorce Process: Step-by-Step
The divorce process in England and Wales is now more straightforward following the introduction of no-fault divorce, which means you don’t need to provide a reason for ending your marriage. Here’s how it works:
1. Checking Eligibility
Before applying for a divorce, you must ensure:
You’ve been married for at least one year.
Your marriage is legally recognised in England and Wales.
Your relationship has permanently broken down.
2. Submitting the Divorce Application
You can apply for a divorce either on your own (sole application) or jointly with your spouse. This can be done online or via paper forms submitted to the court. A £593 court fee is payable when submitting the application.
3. Acknowledgement of Service
If you apply alone, your spouse will receive the divorce application and must respond within 14 days. If they do not reply, there are legal steps to ensure the divorce progresses.
4. Reflection Period
There is a built-in waiting period of 20 weeks after the court issues the application. This gives both parties time to consider arrangements regarding finances, property, and children.
5. Applying for the Conditional Order
After the 20-week reflection period, you can apply for a Conditional Order (previously called a Decree Nisi). This is a legal document confirming the court sees no reason why the divorce cannot proceed.
6. Applying for the Final Order
Six weeks after the Conditional Order is granted, you can apply for the Final Order (previously called a Decree Absolute), which legally ends the marriage.
Financial Settlements & Child Arrangements
While a divorce legally ends the marriage, it does not automatically resolve financial matters or child arrangements. Our expert family law team at Bank Solicitors can assist with:
Financial Settlements
Division of assets, including property, savings, and pensions
Drafting Consent Orders to legally protect your settlement agreement
Handling complex financial disputes involving businesses or international assets
Child Arrangements
Agreements on child custody and visitation
Child maintenance agreements
Representing you in court if necessary
