My partner won’t let me see my children. What are my rights?
If you have been stopped from seeing your children, it can be extremely distressing all round. The first thing to do would be to try and communicate with your partner and come to some sort of arrangement. Having said that, we understand that when relationships break down this can be difficult.
If you feel like you are getting nowhere, then there is an option to go to court to get a contact order. This is a legally enforceable document that states how often you should have contact with your child.
For the court, the child’s welfare is always paramount and they will consider a number of different things when making decisions. They may consider where the parents live, what school a child attends, after school activities and the logistics of contact arrangements.
Unless there is a very good reason to the contrary, then a child should have contact with both parents.
